One recurring issue that we encounter is that of hosting copyrighted content. Currently we avoid hosting copyrighted content, using only fair-use representations. However, there are situations where it might be beneficial for both NBC-Universal and ourselves if we were to be granted license to mirror some of their copyrighted content. This proposal seeks to determine the consensus regarding whether we should contact NBC-Universal to seek out such license, or whether to continue utilizing only fair-use material.
Copyright Strategy
In the course of trying to host episode transcripts, we established a point of contact at NBC-Universal that we might utilize to request permission/license to host/mirror copyrighted material. Examples of material that might be beneficial to host/mirror would include the podcasts (the actual audio files), video blogs/Q&A's, Webisodes, and high-resolution promotional images.
All of the above are copyrighted material, and thus would require explicit license for us to host/mirror it.
Major obstacles to this include: Prior failure (see the episode transcripts). Our status as a for-profit, third-party entity (financially speaking, not saying that anybody's getting rich off of this).
In our favor: The fact that this entire site is essentially a gigantic advertisement for their product. The fact that there is an entire subsection of the site dedicated to helping people buy merchandise from them. The fact that we truly just want to help, and to be the best possible Battlestar Galactica resource, without any any way compromising their copyright interests.
