Rutherford is a ticket master at Los Angeles International Airport.
Max is an officer with the New York State Police who rides in car seven, unit 1711.

Rutherford is at the front desk when Troy and Dillon ("Smith" and "Jones" respectfully) arrive on flights prepared for them by Jamie Hamilton to intercept the damaged craft heading towards New York, as use of their Vipers would further alert the United States government. After some initial confusion about the pronunciation of "A.M.," Dillon hands her a paper given to them by Hamilton, which Rutherford confirms as Flight 2 to New York City.
He points out the smoke plumes and explosions from the crash of the A-B Raider to his partner, Leroy, as they are roughly 60 miles north of New York City.

She can tell they don't travel by air, since they ask about the metal detector scanners they have to pass through due to the threat posed by hijacking The Night the Cylons Landed, Part I.
Max encounters Troy and Dillon, who he believes survived the crash—although it confuses him how they were able to survive such a wreck. He later suspects them to be drug smugglers or dealing in something illegal and, on that hunch, sends Leroy to check out the crash site, wanting to take whatever credit for the bust they can before someone else would.

Both he and Leroy later attempt to arrest the Warriors, who claim they want to give a statement, but are subsequently stunned The Night the Cylons Landed, Part I.
